A Cloud-a-Day Keeps the Conflict Away!
And Justice for All. An Attorney's Conflicts
People who are involved in legal system, like judges, prosecutors and attorneys are dealing with conflicts constantly. They are expected that they will settle conflicts that are assigned to them. However, those lawyers themselves have often to face some painful dilemmas.
Above all other lawyers, attorneys are exposed to dilemmas like: If you are an attorney and you believe your client is guilty, should you still wholeheartedly defend them? How can you defend a person you know is guilty?
In a very impressive way, the subject we are speaking about was presented in the movie And Justice for All (1979, directed by Norman Jewison). From the cover of the DVD: "In a criminal justice system where criminals go free, lawyers and judges make deals as a matter of routine and the innocent sometimes go unprotected, young lawyer Arthur Kirkland begins to wonder where the justice has gone. Arthur (Al Pacino) is an honest, idealistic lawyer who is suddenly (1) under pressure to defend a distinguished judge (John Forsythe) accused of raping and battering a young girl - and whom Arthur knows is guilty. Jack Warden co-stars as an eccentric judge who thinks Arthur should play the game. When it comes down to the trial, (2) Arthur must choose between the security of his career and his personal integrity. The final, explosive courtroom scene is unforgettable!"
In that short summary of the story, we can see at least two dillemmas that Arthur Kirkland had to face. The respective Clouds could look like this:
"We wanna win. ... Winning is everything."
You can have a look bellow how Arthur solved for himself his second dilemma. It is a real breakthrough.
And, when you will hear Arthur saying during his opening statement: "We have a problem here. Do you know what is it? Both sides wanna win. We wanna win. We wanna win regardless of the truth, we wanna win regardless of justice, regardless of who is guilty or who is innocent. Winning is everything." you can think about causes why WIN-WIN solutions are so difficult to achieve and about consequences of that situation.
